1. Introduction

Welcome to FiveThirty Learning. These Terms of Service govern your use of the FiveThirty Learning platform, accessible at thefivethirty.com and any associated subdomains, applications, and services.

FiveThirty Learning is operated by THEFIVETHIRTY PTE LTD (UEN 202615461R), a company incorporated in Singapore. By creating an account or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use the platform.

We may update these Terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the platform after changes take effect constitutes acceptance of the revised Terms.

2. Eligibility

2.1 Age requirement. You must be at least 16 years old to create an account. During registration, you are required to confirm that you are 16 or older. If you are under 16, you may not use the platform.

2.2 Parental awareness. If you are between 16 and 18 years old, we encourage you to review these Terms with a parent or guardian. While parental consent is not required for users aged 16 and above under Singapore’s Personal Data Protection Act (PDPA), we recommend that parents are aware of their child’s use of the platform.

2.3 Accuracy of information. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3. Account and Access

3.1 Account creation. You may create an account using an email address and password, or via Google OAuth. You are responsible for maintaining the confidentiality of your login credentials.

3.2 One account per person. Each account is personal to you. You may not share, transfer, sell, or rent your account or credentials to any other person.

3.3 Account security. You are responsible for all activity that occurs under your account. If you become aware of any unauthorised use, you must notify us promptly at hello@thefivethirty.com.

4. Content and Modules

4.1 Platform content. FiveThirty Learning provides structured mathematics learning content designed for IB Higher Level Mathematics students. Content includes video lessons, practice questions (multiple choice, free response, and drag-and-drop), worked solutions, and spaced-repetition reviews.

4.2 Free preview. Certain modules or chapters may be made available as a free preview. Free preview content may be changed or withdrawn at any time without notice.

4.3 Module purchases. Paid modules are available for individual purchase. Each purchase grants you access to the module content for a period of one (1) year from the date of purchase. After this period, access expires unless renewed.

4.4 No perpetual licence. A module purchase is a time-limited licence to access digital content. It is not a sale of goods. You do not acquire any ownership rights in the content.

4.5 Content updates. We may update, modify, or reorganise content within a module during your access period to improve quality or accuracy. We will not remove a module you have purchased during your access period, but individual questions or lessons within it may be revised.

5. Pricing and Payment

5.1 Currency. All prices are displayed in Singapore Dollars (SGD).

5.2 Payment methods. Payments are processed through Stripe and/or HitPay. By making a purchase, you agree to the payment processor’s terms of service in addition to these Terms.

5.3 Taxes. Prices displayed exclude applicable taxes unless stated otherwise. You are responsible for determining and paying any taxes, duties, or government charges applicable to your purchase in your jurisdiction, including but not limited to GST, VAT, or similar consumption taxes.

5.4 Singapore GST. FiveThirty Learning is not currently registered for GST in Singapore. Should we become GST-registered, Singapore GST at the prevailing rate will be added to purchases by Singapore-based customers, and you will be notified of the change at checkout.

5.5 Refunds. Due to the digital nature of the content, all purchases are final. No refunds will be issued once access to a module has been granted. If you experience a technical issue that prevents you from accessing purchased content, please contact us at hello@thefivethirty.com and we will work to resolve it.

6. Acceptable Use

You agree not to:

• Copy, reproduce, distribute, or publicly display any content from the platform without our prior written consent.
• Use automated tools, scrapers, or bots to access or extract content from the platform.
• Attempt to circumvent access controls, entitlement checks, or security measures.
• Share, resell, or redistribute your account access or purchased modules.
• Use the platform for any unlawful purpose or in violation of any applicable law.
• Interfere with the operation of the platform or attempt to gain unauthorised access to our systems.

We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms.

7. Intellectual Property

7.1 Our content. All content on the platform — including text, questions, solutions, videos, images, icons, and software — is the property of FiveThirty Learning or its licensors and is protected by copyright and other intellectual property laws.

7.2 Limited licence. Subject to these Terms, we grant you a personal, non-exclusive, non-transferable, revocable licence to access and use the platform content for your own private educational purposes during your access period.

7.3 No derivative works. You may not create derivative works based on our content, including but not limited to compiling questions into separate documents, recording video lessons, or reproducing content in any other educational material.

8. Progress Data and Learning Records

8.1 Data we record. The platform records your learning progress, including quiz responses, completion status, review session history, and spaced-repetition state. This data is used to personalise your learning experience and provide recommendations.

8.2 Immutable records. Progress session records are stored as immutable data and cannot be individually deleted during your access period. This is necessary for the integrity of the spaced-repetition system.

8.3 Data retention. Your progress data will be retained for the duration of your access period. After your last module access expires, progress data will be retained for a maximum of one (1) year or until the end of the relevant IB examination session, whichever is earlier, after which it will be deleted.

8.4 Data export. You may request an export of your progress data by contacting us at hello@thefivethirty.com.

9. Service Availability

9.1 Availability. We aim to keep the platform available at all times but do not guarantee uninterrupted access. The platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9.2 No warranty. The platform and its content are provided on an “as is” and “as available” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or suitability of the content for any particular purpose, including examination preparation.

9.3 Limitation of liability. To the maximum extent permitted by law, FiveThirty Learning’s total liability to you for any claims arising from or related to the platform shall not exceed the total amount you have paid to us in the twelve (12) months preceding the claim.

10. Termination

10.1 By you. You may close your account at any time by contacting us at hello@thefivethirty.com. Closing your account does not entitle you to a refund for any remaining access period.

10.2 By us. We may suspend or terminate your account if you breach these Terms. In cases of serious or repeated violations, termination may be immediate and without refund.

10.3 Effect of termination. Upon termination, your right to access the platform and any purchased content ceases immediately. Sections 7 (Intellectual Property), 8 (Progress Data), 9 (Service Availability), and 11 (Governing Law) survive termination.

11. Governing Law and Dispute Resolution

11.1 Governing law. These Terms are governed by and construed in accordance with the laws of the Republic of Singapore.

11.2 Dispute resolution. Any dispute arising from or relating to these Terms shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Singapore.
